For schools: It’s becoming more and more clear that wearing mask and social distancing are optional based on the actual law. It is a violation to discriminate by forcing mask wearing and social distancing by up to $50,000 fines. Stores are being notified by our Hawaiian Assembly that they must respect people’s medical exemptions.
Approx. 80% of the public establishments approached are posting placards which say that if one is not wearing a mask they recognize their medical exemption and that they are not required by law to ask what the exemption is for. Basically, by posting the placard they stating people can wear a mask or not, and they will avoid being in violation and paying fines.
The State of Hawaii’s illegal mandates state people “Shall wear face covering and social distance”. In Legalese “shall” actually translates to “may”- as in optional. They are not giving full disclosure on the reality of exemptions. This means they’ve taken up the liability by not acknowledging those who wish to opt-out due to a medical condition. Everyone has been going along with it therefore no one has been challenging it… until now.
The teachers, the faculty and the students all have a right to declare a medical exemption… and it is ILLEGAL to require those declaring a medical exemption to have to show a reason for it ie) a document disclosing their medical condition.
Illegal mask and social-distancing mandates are flawed and cannot be upheld for the following reason: #1. They can’t legally mandate you to wear it, because unless you have a health license you can’t give health recommendations or advice legally. #2. It’s against the ADA and you do not need to disclose your health issue ever due to HIPA guidelines. #3. Any public accommodations will need to provide equal access to everyone without discrimination #4. Government or any other public officials who pushes this can be found guilty of constitutional offense which equates to $50k per violation each day counting as a new violation.
Furthermore the school must have insurance covers insurance to cover them for essentially making medical recommendations to children. What if a child wears it and they do get sick? The school must have insurance to cover that which they most likely do not. There are three degrees of felonies for child abuse which school officials can be convicted of based on the child abuse for which the false edicts being pushed on our children can be interpreted as. The violations of medical intervention outlined need to be addressed or the grievance will be filed.
